On Friday, the Supreme Court delivered a stunning verdict that exposed Donald Trump caught red-handed orchestrating what may be the biggest heist of the 21st century. The court struck down his tariff scheme, declaring it illegal because the power of taxation belongs to Congress, not the president. “The Framers did not vest any part of the taxing power in the Executive Branch,” Chief Justice John Roberts wrote for the court’s majority. This ruling revealed that Trump had been collecting hundreds of billions of dollars from American families through unauthorized taxes disguised as tariffs.

Hours before the court’s ruling, news broke about the US economy slowing down much faster than economists expected. Consumers pulled back sharply on spending, and the reason was obvious. Trump’s tariff scheme amounted to the biggest tax increase of the last three decades, according to the Tax Foundation. Some analysts at JP Morgan Chase went even further, calling it the largest tax hike since 1968.
The numbers tell a shocking story. The New York Times reported that the government collected nearly $290 billion in customs duties last year, triple what was collected the year before. But here’s the kicker: Last week, the Federal Reserve Bank of New York issued a report showing that more than 90 percent of that money came straight out of the pockets of American consumers.
This wasn’t some abstract policy debate about trade. This was real money taken from real families. Consumer confidence collapsed last month to its lowest level since 2014 as people watched their purchasing power vanish. The quarter was shaping up to be even worse as Americans struggled to afford basic goods.
The court probably saved Trump from burning through what remained of the American middle class and sparking a massive backlash in this year’s midterm elections. Even people who pay little attention to politics noticed the pain. Polls showed his handling of prices rated at negative 40 percent.
An Illegal Operation Exposed
In saving Trump from himself, the court made something crystal clear that Americans may not have fully understood before Friday morning. Tariffs are taxes, plain and simple. And thanks to the court, everyone now knows the biggest tax hike since the Clinton administration was completely illegal.
So yes, the court may have saved Trump from further political damage. But it also handed his opponents powerful ammunition to accuse him of pulling off the biggest heist of the 21st century. Because of this massive burglary, the economy ground to a crawl. We’re talking about nearly $290 billion, with some estimates reaching upwards of $1 trillion, almost all of it paid by ordinary Americans like you and me.
Even Justice Brett Kavanaugh accidentally admitted there had been a robbery and that victims deserved compensation. In his dissent, he worried that Trump’s tariff scheme was too complicated to unwind, with the primary problem being refunds.
“The court’s decision is likely to generate other serious practical consequences in the near term,” Kavanaugh wrote. “One issue will be refunds. Refunds of billions of dollars would have significant consequences for the US treasury. The court says nothing today about whether and if so how, the government should go about returning the billions of dollars that it has collected from importers, but that process is likely to be a mess.”
Of course, Kavanaugh was talking about refunds to importers, which makes the injustice even worse. Those importers didn’t ultimately pay the tariffs. American consumers did.
Time for Justice and Refunds
Democratic leaders should make a straightforward deal with voters: Give us Congress in November and we’ll pass a law forcing Trump to return the money he took from you. Moreover, Democrats should challenge their Republican counterparts to codify Trump’s tariffs and risk the justified accusation that the president not only picked the people’s pockets but his party now wants to make pickpocketing legal.
Senate Democrats have already introduced legislation requiring the administration to refund up to $175 billion collected through these illegal tariffs. The question is whether Republicans will support returning this stolen money to American families.
Republicans probably won’t have to go that far, though. Justice Kavanaugh, in his dissent, actually suggested ways for the president to get around the ruling. And sure enough, that’s exactly what Trump plans to do. During his press conference, where he said he was “absolutely ashamed” of the high court, Trump announced a new set of global tariffs under a different law that restricts levies to 150 days.
The Criminal Intent Behind the Scheme
People often say Trump doesn’t understand how tariffs work, but that’s wrong. He understands perfectly. He knows what they really are: leverage against wealthy individuals, corporations, and countries he’s trying to extort. Reports today confirmed he was furious with the court, not because it “set back his agenda,” but because it took away his most powerful tool for seeking bribes.
The president’s criminal intent came into sharp focus during the press conference, though it was so subtle most people missed it. A reporter asked why Trump didn’t work with Congress to establish import taxes rather than pursuing another round of tariffs that would end up challenged in court again.
Trump’s reply: “Because I don’t have to.”
“I have the right to do tariffs,” he said. “I’ve always had that right to do tariffs. It’s all been approved by Congress. There’s no reason to do it.”
Think about that for a moment. The Supreme Court had just ruled that he can’t impose tariffs unilaterally, that “the Framers did not vest any part of the taxing power in the Executive Branch,” and that his actions were illegal. Congress has not approved new taxes and almost certainly won’t. Yet Trump insisted he has the right to continue.
Even though the Supreme Court ruled Trump’s tariffs are illegal, the criminal intent behind them hasn’t changed one bit. US Treasury Secretary Scott Bessent said, in so many words, that the theft of the American people will continue through 2026. As for the money already stolen from us? He said: “I got a feeling the American people won’t see it.”
That’s the boldest admission yet. They took your money illegally, and they’re telling you straight up that you won’t get it back. That’s not a policy disagreement. That’s a heist, caught red-handed, with no intention of making things right.
